Reviewing the Trial Record
The first step for an appellate attorney is to meticulously examine the trial court’s record. This includes reviewing transcripts, evidence, and any other relevant documents from the initial trial to identify potential errors or grounds for appeal.
Crafting the Appellate Brief
Once the trial record is reviewed, the appellate attorney proceeds to draft the appellate brief. This document is the cornerstone of the appeal and must persuasively argue why the lower court’s decision should be upheld or overturned.
Oral Argument
If the appellate court grants a hearing, the attorney will present an oral argument before a panel of judges. This step involves articulating the key points from the appellate brief and responding to questions from the judges.
